WhatsApp chatbot in Mexico (2026): the new data protection law, Meta's peso rates, and what Mexican customers expect
For clinics, real estate agencies, schools, shops and service businesses in Mexico, or selling to Mexican customers, that want WhatsApp answered without adding staff. You get a plain reading of the 2025 data protection law that replaced the old one, Meta's MXN rate card with a worked example, and the local habits that shape a good setup.
Quick answer
A WhatsApp chatbot is legal in Mexico when you give a privacy notice, collect only what you need and answer ARCO requests within 20 days, under the federal data protection law published on 20 March 2025, now enforced by the Secretaría Anticorrupción y Buen Gobierno. On the official API, Meta charges MXN 0.1565 per utility or service message (1,000 service messages free per number monthly) and MXN 0.7298 per marketing message.
What changed in Mexican data protection law in 2025?
Mexico replaced its private-sector privacy law. A new Ley Federal de Protección de Datos Personales en Posesión de los Particulares was published in the Diario Oficial de la Federación on 20 March 2025 and came into force the next day, abrogating the 2010 law of the same name. The reform came with the dissolution of the INAI, the autonomous regulator most business owners knew.
The new law names the Secretaría Anticorrupción y Buen Gobierno as the authority (article 2 defines "la Secretaría" that way). If your privacy notice still tells customers to complain to the INAI, it is out of date.
Two other changes matter for a small business. Fines are now calculated in UMA (the Unidad de Medida y Actualización) instead of the minimum wage, and, according to the law firm Garrigues' summary of the reform, negligent or deliberate mishandling of ARCO requests is now an infraction in its own right. A chatbot that ignores "borra mis datos" is no longer a harmless bug.
What does the law ask of a WhatsApp chatbot, point by point?
Most of it is common sense you can set up in an afternoon. The table pairs each requirement in the law with what it means on WhatsApp.
| Requirement | What the 2025 law says | What to do on WhatsApp |
|---|---|---|
| Aviso de privacidad | Must be available from the moment data is collected; article 15 lists the contents, including who you are, what data, which purposes need consent, and how to exercise ARCO rights | Put a short notice and a link to the full one in your greeting or business profile |
| Consent | Tacit consent is generally valid once the notice is made available and the person does not object, unless the law requires express consent (article 7) | The notice link does most of the work for ordinary enquiries |
| Sensitive data | Requires express and written consent (article 8) | If you run a clinic, do not let the bot collect symptoms or health history; hand those chats to staff |
| ARCO requests | Answer within a maximum of 20 days; if granted, act within 15 days of the answer (article 31), with one possible extension | Tell the agent to escalate any access, correction, deletion or objection request to you at once |
| Enforcement | Secretaría Anticorrupción y Buen Gobierno; fines in UMA | Update old notices that mention the INAI |

How much will Meta charge you in pesos?
Meta has offered billing in Mexican pesos since 1 January 2026, the earliest of the ten currencies it added during 2026. The MXN rate card effective 1 October 2026, for messages to Mexican numbers:
| Category | When it applies | MXN per message |
|---|---|---|
| Marketing | Offers, Buen Fin and Hot Sale promotions, reactivation | 0.7298 |
| Utility | Appointment reminders, order and delivery updates | 0.1565 |
| Authentication | Verification codes | 0.1565 |
| Service | Replies within 24 hours of the customer's message | 1,000 free per number per month, then 0.1565 |
| Free entry point | Replies after a click-to-WhatsApp ad, inside the window (up to 7 days) | Free |
Worked example. A dental clinic in Guadalajara sends 3,000 replies and 800 appointment reminders a month. After the 1,000 free replies, Meta charges 2,000 replies (MXN 313.00) and 800 reminders (MXN 125.20): MXN 438.20 a month before provider fees and IVA. A Hot Sale promotion to 4,000 past patients would add MXN 2,919.20 on its own. The pattern holds across markets: answering is cheap, broadcasting is not. If your WhatsApp is mostly questions and bookings, compare that with a flat plan with no Meta charges on our pricing page. The API pricing explainer covers the categories, and the Brazil guide shows the same sums in reais.
How do Mexicans message and pay?
Messaging is near universal among smartphone users; payments are moving from cash to transfers. Both affect what your agent needs to say.
- 86.1% of people aged 6 and over used the internet in 2025, about 104.9 million people (INEGI, ENDUTIH 2025, published June 2026).
- 90.6% of smartphone users used instant messaging apps in 2025, more than used social networks (80.4%) (INEGI, ENDUTIH 2025).
- Statista's Consumer Insights survey for April 2024 to March 2025 ranks WhatsApp first among messengers used in Mexico.
- Cash is still the most frequent way to pay, but its share fell between 2021 and 2024 while card and transfer use grew; transfers or mobile apps for purchases over 500 pesos rose 4.8 percentage points (INEGI, ENIF 2024).
- 69.1% of adults with a formal savings account used a mobile app to check or move money in 2024, up from 54.3% in 2021 (INEGI, ENIF 2024).
What it means: write your payment options into the agent's knowledge in plain words (transfer details shared by a person, card at the counter, cash on delivery if you offer it) and have it hand over when someone says "ya te transferí", so a person checks the account. ReplyKit does not take payments in the chat.
What Mexican Spanish should your agent understand?
The Spanish your customers type is not textbook Spanish, and the vocabulary is local. Put these words into your knowledge base with your real answers:
- "¿Cuánto sale?" and "¿qué precio tiene?" The two most common price questions. Answer with your actual price list, not "depende".
- Cotización. Many service businesses quote rather than list prices. Tell the agent which details it needs (measurements, photos, colonia) before a quote, and when to pass it to you.
- Meses sin intereses. If you offer interest-free instalments, say on which cards and for how many months. If you do not, say that clearly.
- Factura. Customers often ask whether you issue invoices. The agent should know the answer and what data you need, then hand over; do not let it collect tax details itself.
- Cita, apartar, agendar. Booking words. The agent offers real open slots and books them.
ReplyKit understands voice notes and photos on every plan and replies in the customer's language, so a customer in Monterrey and a tourist writing in English get answers from the same facts. Our piece on slang, typos and mixed languages shows how this works.
Meta tested its Business AI in Mexico first. Should you just use that?
Maybe. On its October 2025 earnings call Meta said Mexico and the Philippines were its initial test markets for Business AI and that it had expanded availability on WhatsApp to all eligible businesses in Mexico. By its April 2026 call Meta reported more than 10 million weekly conversations with Business AIs across its messaging apps, and said the tools were then free for most businesses.
Meta's agent is a good first step for a shop with a catalog and simple questions. A third-party agent makes sense when you need answers from your own documents and price lists, real appointment booking, lead scoring, a shared inbox for staff, or a website assistant that uses the same knowledge. We compare the two honestly in ReplyKit vs Meta Business Agent.
Where ReplyKit fits for Mexican businesses
We make ReplyKit, so weigh our view accordingly. It answers WhatsApp and website chat from your own content, books into real open slots with a reminder about 24 hours before, captures name, need, budget and timing, and scores leads hot, warm or cold. You can take over any chat in one click, and it says "I am not sure" and escalates instead of guessing.
It connects through Quick Connect, a QR scan that pairs your number in about two minutes. That route is unofficial: it is not the WhatsApp Business API, it is not sanctioned by Meta, and a number can be restricted. You see one plain notice before connecting, and pressing Connect is your acceptance of section 3 of our Terms. Use a dedicated number. Because it does not use the API, there are no Meta charges at all, and it never sends broadcasts.
Plans are in US dollars: $29, $49 or $99 a month. Start a 7-day free trial without a card and test it on last week's real messages.
Not the right choice if you run Buen Fin or Hot Sale broadcast campaigns, need a verified badge, need invoices in pesos, or need payments inside the chat. An official-API provider fits those jobs; our API vs QR pairing comparison sets out the trade-off.
Frequently asked questions
Is it legal to use a WhatsApp chatbot in Mexico?
Yes. Answering customers who message you is ordinary customer service. Under the federal data protection law published on 20 March 2025 you need a privacy notice available when you collect data, consent where the law requires it, and a way to handle ARCO requests. This is not legal advice.
Who enforces data protection in Mexico now that the INAI is gone?
The 2025 law names the Secretaría Anticorrupción y Buen Gobierno as the authority for personal data held by private businesses. Privacy notices that still refer customers to the INAI should be updated.
How fast must I answer an ARCO request?
The law sets a maximum of 20 days to respond to an access, rectification, cancellation or objection request, and if you grant it you must carry it out within 15 days of your answer. The first period can be extended once when justified.
How much does WhatsApp Business API cost in Mexico?
Meta's MXN list rate for Mexican numbers, effective 1 October 2026, is MXN 0.7298 per marketing message and MXN 0.1565 per utility, authentication or service message, with 1,000 service messages free per number each month. Provider fees and IVA come on top.
Can I pay Meta in Mexican pesos?
Yes. Meta added MXN as a billing currency on 1 January 2026, and once a messaging account's currency is selected it cannot be changed, though Meta offers currency migration tools.
Is Meta's Business AI available in Mexico?
Yes. Meta used Mexico as an early test market and said in October 2025 that it had opened Business AI on WhatsApp to all eligible businesses there. It suits simple catalog questions; a third-party agent adds booking, your own documents and lead scoring.
