WhatsApp chatbot in Kenya (2026): ODPC registration, M-Pesa confirmations and what it really costs
This guide is for Kenyan clinics, schools, salons, property managers and shops that want WhatsApp answered without hiring. It starts with the question most guides skip, whether you must register with the Office of the Data Protection Commissioner first, then covers Meta's charges, the M-Pesa moment in every sales chat, and Kiswahili and Sheng.
Quick answer
Kenyan businesses with under KES 5 million turnover and fewer than ten employees are exempt from ODPC registration, unless they work in listed sectors such as education, health care, hospitality, property management, financial services or transport. On the WhatsApp API, Kenyan numbers are charged Meta's Rest of Africa rates: $0.0225 per marketing message and $0.004 per utility or service message.
How widely is WhatsApp used in Kenya?
Very widely. In the Reuters Institute's Digital News Report 2025, 74% of the Kenyan sample used WhatsApp in the past week for any purpose, close behind YouTube (78%) and ahead of Facebook (70%). The sample is English-speaking and online, so it leans urban and younger, which matches most businesses' WhatsApp customers.
The same report notes WhatsApp's use for news fell 14 points as X and TikTok grew, but that is about news. For "is the 2pm slot free?" and "bei ni ngapi?", WhatsApp is still the default line to a Kenyan business.
Do you need to register with the ODPC before using a WhatsApp chatbot?
It depends on your size and your sector, not on the chatbot. The Data Protection (Registration of Data Controllers and Data Processors) Regulations, 2021, made under the Data Protection Act, 2019, exempt a business from mandatory registration if it has annual turnover or revenue below KES 5 million and fewer than ten employees. But that exemption does not apply if you process personal data for any purpose in the Third Schedule.
| Your business | Under KES 5m and under 10 staff? | Must register? |
|---|---|---|
| Small retail shop or online store | Yes | No (exempt), but the Act still applies |
| Salon or barber | Yes | No (exempt), but the Act still applies |
| Dental or medical clinic | Yes | Yes: health administration and patient care |
| Tuition center or private school | Yes | Yes: operating an educational institution |
| Guest house or restaurant | Yes | Yes: hospitality firms (tour guides excluded) |
| Property manager or land seller | Yes | Yes: property management, including selling land |
| Chama lender, SACCO agent or insurer | Yes | Yes: provision of financial services |
| Taxi, boda or delivery operator | Yes | Yes: transport services firms |
| Any business over KES 5m or with 10 or more staff | No | Yes |
Other Third Schedule purposes include gambling, operating security CCTV systems, telecoms, processing genetic data, and businesses wholly or mainly in direct marketing. For a micro or small business (1 to 50 employees, turnover up to KES 5 million) the registration fee is KES 4,000, renewed every two years for KES 2,000, and a certificate is valid for 24 months. Even exempt businesses must still comply with the Act's core principles and obligations; the exemption is from registering, not from the law.
What else does the Data Protection Act expect when you automate WhatsApp?
The same habits any careful business should have, applied to chats. A WhatsApp chatbot collects names, numbers and sometimes health or financial details, so:
- Say who you are and why you collect data. A one-line notice in your greeting with a link to your privacy notice. Our privacy notice guide has wording.
- Collect only what you need. Name, need and preferred time is enough to book. Do not ask for ID numbers in WhatsApp unless the service truly requires them.
- Do not message people who never contacted you. Direct marketing is a regulated purpose in its own right; an inbound-only agent avoids it.
- Know where your tool stores data and how to delete it. When a customer asks you to delete their details, you need to be able to.
This is a summary, not legal advice. A clinic or lender should take advice on sensitive data.
How much does a WhatsApp chatbot cost in Kenya?
On the official API, Kenya is not a standalone market. Meta charges Kenyan (+254) numbers its "Rest of Africa" regional rate, in US dollars; the shilling is not one of the 16 currencies Meta bills in as of October 2026.
| Message type | Meta rate, Rest of Africa (includes Kenya) | Nigeria, for comparison |
|---|---|---|
| Marketing | $0.0225 | $0.0516 |
| Utility and authentication | $0.004 | $0.0067 |
| Service (replies), after 1,000 free per number each month | $0.004 | $0.0067 |
That changes how you should compare tools. Ask each provider for its monthly fee, whether AI replies are included or an add-on, and whether it marks up Meta's rates. Our cost guide shows where those fees hide.
How should a WhatsApp chatbot handle M-Pesa payments?
By giving the right Paybill or till number, then handing the confirmation to a person. Safaricom reported 40.99 million one-month active M-Pesa customers in Kenya in its results for the year to March 2026, as reported by The Kenya Times, so nearly every sales chat ends with an M-Pesa payment.
What the agent does
Answers "Paybill ni gani?" with your Paybill or till number and account format, explains your deposit rule, and books the slot, all from your knowledge.
What the agent must not do
Confirm a payment. ReplyKit does not take payments or check whether money arrived, and a pasted confirmation message can be edited.
The handover
When a customer pastes an M-Pesa confirmation or sends a screenshot, the agent thanks them and passes the chat to you. You check your statement and confirm.
Why it matters
A wrong "payment received" is the most expensive mistake a chatbot can make. Keep that one decision human. See how handover works.
Can a WhatsApp chatbot reply in Kiswahili and Sheng?
An AI agent can understand the mix and reply in kind; a keyword bot will not. Kenyan customers move between English and Kiswahili in one message, and younger customers add Sheng.
| Customer writes | Meaning | Good reply |
|---|---|---|
| "Bei ni ngapi?" | What is the price? | The price, in Kiswahili, plus what is included |
| "Mko wazi Jumapili?" | Are you open on Sunday? | Your Sunday hours, or the next open day |
| "Naweza book appointment kesho asubuhi?" | Can I book tomorrow morning? | Two real morning slots |
| "Niaje, hii kitu iko?" | Hi, is this item available? | Stock answer, friendly, without copying the slang |
ReplyKit works in over 30 languages, mirrors the language the customer writes in, and understands voice notes and photos on every plan. Kiswahili quality is something to check yourself, and Sheng changes fast, so test your own recent messages before going live. Our guide to slang and mixed languages explains how this works.
Where does ReplyKit fit for Kenyan businesses?
ReplyKit is an AI agent that answers WhatsApp and website chat from your own content, qualifies leads (name, need, budget, timing), books appointments into real open slots with a reminder about 24 hours before, and hands any chat to you in one click.
It connects through Quick Connect, an unofficial QR pairing of your WhatsApp or WhatsApp Business number as a linked device, in about two minutes. It is not the API, not sanctioned by Meta, and a number can be restricted. You see one plain notice before connecting; pressing Connect is your acceptance of section 3 of our Terms. Use a dedicated number. It replies only, never broadcasts, and stays within default limits of 30 AI replies an hour and 200 a day.
The honest Kenya maths. Because Meta's rates for Kenya are so low, "no Meta fees" saves you a few dollars, not hundreds. Choose ReplyKit for the parts that cost real time: AI included in a flat price ($29, $49 or $99 a month in US dollars), booking without a Calendly link, and lead scoring. Start the 7-day free trial with 300 replies and no card, or see the plans.
Not the right choice if you need M-Pesa collection inside the chat, broadcasts, a green tick, or invoicing in shillings. For those, look at an official API provider with payment features.

Only if you are not exempt.
